The "more AI" phase is ending. For the past two years, professional firms have been buying, piloting, and mandating AI tools at a pace that’s outrun user-adoption capability. As a result, firms are investing at a high rate, with disappointing returns on investment. The cost is catching up, and the questions are getting harder. The firms pulling ahead aren't just buying more AI — they're making sure they’re buying the right AI for the right reasons.

In Normal Accidents (1984), the sociologist Charles Perrow argued that accidents are inevitable in complex, tightly coupled systems. Slowing AI development, as Anthropic’s chief executive has proposed, may buy time, but it cannot remove the need for a techno-legal infrastructure that makes a stop possible and prepares for its failure. Lawmakers should use that time to build it, before the next AI crisis.

“An astonishing theft of unprecedented proportions”: Court records show what Microsoft and OpenAI actually thought about AI training — “Internal Microsoft communications identified the ‘real risk’ that generative AI could ‘significantly disrupt the employment of the very people who generated the data on which the foundation model was trained.’ A separate policy document put it […]
Arbitration may happen behind closed doors, but its data travels through cloud drives, inboxes and AI tools with the windows wide open. From phishing and poorly regulated cloud platforms to Open-Source AI assistants, here we unravel the weak links hiding inside modern dispute resolution.
SaaS contracting long followed a predictable model. Vendors supplied infrastructure, storage, processing capacity, and uptime commitments, while customers brought their data. Software behaved the same way every time, outputs were generally deterministic, and risk allocation was reasonably straightforward. You could explain, audit, and draft contracts around the workflow.

Yesterday, Dave Winer shared that librarians are the unsung heroes of the web. It’s so true, just read the points Winer made. Yes, listen to librarians, they will have ideas to start. We charted the course for The Library at LexBlog as“Preserving and structuring the insight of legal professionals as secondary law.” Can you get...
The new federal omnibus bill on the economy – Bill C-39, the Building Canada Strong Act – contains in Part 2 (“Keep Canada Moving”) Division 8, the Enabling Digital Trade Act. This text implements for international trade in Canada the UNCITRAL Model Law on Electronic Transferable Records (MLETR). It allows, though does not require, the use of electronic versions of transferable records. Transferable records transfer title to the goods or sums mentioned in them by the transfer of the records them
The debate over AI and copyright policy, and how to ensure remuneration for right holders, is gaining momentum around the world. There have been calls to review EU copyright law, India has proposed the introduction of a statutory licensing scheme , and the Australian Government is working behind the scenes to develop its own solution. In October 2025, the Australian Government rejected the introduction of an EU-style TDM exception to cover AI development activities and, instead, suggested that v
Most enterprises have solved where documents live. Far fewer have solved how those documents remain governed once they are accessed, revised, approved, shared, or moved beyond their original repository. That distinction is becoming increasingly important for enterprise information governance, particularly as critical business information moves across legal, finance, compliance, executive, operational, and external stakeholder workflows. Generative AI is now part of election campaigns. Nicky Gillibrand and Marcus Ganley explain their recent research findings on how the EU’s regulatory frameworks dealt with the risks created by generative AI in the 2024 European Parliament elections, how this contrasts with New Zealand’s regulatory approach, and what it means for the UK. With the […]

We recently recorded a podcast with Professor Richard Susskind —arguably the most influential thinker on the future of legal services—to talk through his new book, How to Think About AI: A Guide for the Perplexed . What followed was a candid, insight-rich conversation about where the legal industry is heading. Here are 7 key points about legal AI that Susskind laid out.
GenAI shouldn't just be bolted onto old workflows. Learn why legal teams must rebuild discovery around AI to find the key facts faster.
Back in 2021, EY Law and Harvard Law School’s Center on the Legal Profession found that 87% of legal departments reported spending too much time on low-value, routine tasks. This was years before AI entered the zeitgeist, but even now, with AI tools proliferating across every industry, the shape of the problem remains intact. 92%
Artificial intelligence is moving beyond the chat window. The next generation of tools does not merely draft an email, summarize a document, or answer a question. It can browse the web, search connected systems, open files, follow links, use software tools, upload information, submit forms, and take multi-step action toward an assigned objective. Attorney and legal tech and AI expert Michael D.J. Eisenberg documents in detail how and why implementing AI in a law practice regardless of size deman
Generative tools like DALL·E, Midjourney and Stable Diffusion can now produce an image "in the style of" almost any artist in seconds. That capability sits uneasily with EU copyright law, which has always assumed a human being on the other end of the pen. The pastiche exception in Article 5(3)(k) of the InfoSoc Directive was drafted for exactly this kind of stylistic borrowing -- but for a human borrower.
