One thing I learned over the years about litigating: front end loading and early case assessment were critical for success and strategy. The problem was that took time and clients often balked at paying for it. So when I saw that the recent AI Guide for Litigators from the Thomson Reuters Institute and ILTA focused on just this kind of assessment among other phases, I was intrigued. Here is my discussion for Above the Law of the Guide and how AI can make early case assessment faster and cheaper.

One of the oldest thought experiments in artificial intelligence (AI) safety imagines a powerful AI system with a simple instruction to make paper clips. The system pursues that goal with total devotion. It converts the world’s resources into paper clip factories and resists every effort to shut it down or change its goals. For years, many observers dismissed the scenario as fanciful. A truly intelligent system, the argument went, would weigh paper clips against other moral considerations or at.

Artificial intelligence could help deliver the next generation of lifesaving medicines. It could also weaken the economic foundation that makes discovering those medicines possible. AI is being widely integrated into legal practice and academic research. Early concerns about such tools were focused on the outputs: hallucinated citations, fabricated case law, overall sloppiness among attorneys and researchers submitting AI-generated work without review. The mismatch between the talent and resources of plaintiffs' firms and those of defense firms is widening.
Buying a third-party legal AI product for a defined task may look simpler financially and operationally, and often will be. Partners should still seriously explore building an internal AI capability rather than allowing purchased products to become the firm's entire AI strategy.
The "more AI" phase is ending. For the past two years, professional firms have been buying, piloting, and mandating AI tools at a pace that’s outrun user-adoption capability. As a result, firms are investing at a high rate, with disappointing returns on investment. The cost is catching up, and the questions are getting harder. The firms pulling ahead aren't just buying more AI — they're making sure they’re buying the right AI for the right reasons.

In Normal Accidents (1984), the sociologist Charles Perrow argued that accidents are inevitable in complex, tightly coupled systems. Lawmakers should use that time to build it, before the next AI crisis.
